Terms of sale

1. Scope
These Terms of Sale govern all sales of works concluded on oriancollection.com between ORIAN Collection, a French SASU with share capital of €1,000, registered under SIREN 107334104, with its registered office at 16 boulevard du Château, 92200 Neuilly-sur-Seine ("ORIAN", "we"), and any person purchasing on the site ("the Client", "you").
Placing an order implies unreserved acceptance of these Terms. They prevail over any other document unless otherwise agreed in writing by ORIAN.
2. The works
The works offered are original paintings, created by hand and produced to order in the size selected by the Client.
As each work is painted individually, variations in brushwork, texture, tone and surface necessarily exist compared with the images shown on the site. These variations are inherent to an original work and do not constitute a defect.
Dimensions are given in centimetres, height × width, excluding frame. A tolerance of ± 2 cm applies.
Colours displayed on screen may differ from actual colours depending on your device calibration. On request, we send photographs of the finished work before shipping.
3. Prices
Prices are stated in euros, inclusive of VAT for deliveries within the European Union. Shipping costs are included in the displayed price (see Shipping Policy).
For deliveries outside the European Union, prices are exclusive of local taxes: customs duties, import VAT and related charges remain payable by the Client unless stated otherwise at the time of order.
ORIAN may amend its prices at any time. The applicable price is the one displayed when the order is confirmed.
4. Orders
Orders become firm and final once payment is validated. A confirmation email summarising your order is sent to you.
Before validation, the Client expressly acknowledges, by ticking the box provided, that the work ordered is hand-painted to order according to the Client's chosen composition and size, and that it is therefore not subject to the right of withdrawal (see clause 7).
ORIAN may refuse or cancel any order on legitimate grounds: unavailability of the work, suspected fraud, a prior payment dispute, or a request plainly incompatible with our production capacity. In such cases the Client is refunded in full.
5. Payment
Payment is due in full at the time of order, by card or by the other methods offered at checkout.
For orders above €5,000 and for professional projects, payment by bank transfer in two instalments (50% on order, 50% before shipping) may be agreed in writing.
ORIAN retains ownership of the work until the price has been paid in full.
6. Production, shipping and delivery
Indicative production time is 4 to 6 weeks from order confirmation, plus transit time.
Detailed arrangements are set out in the Shipping Policy, which forms an integral part of these Terms.
Delivery times are indicative. A reasonable delay gives rise to neither cancellation nor compensation. Under article L216-2 of the French Consumer Code, where an agreed delivery date is missed, the Client may — after a formal notice has gone unanswered — terminate the contract and obtain a refund of sums paid.
Risk transfers on physical handover of the work to the Client or to a person designated by the Client.
7. No right of withdrawal
Under article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised.
Because ORIAN works are individually hand-painted after the order is placed, in the size and composition chosen by the Client, no right of withdrawal applies. Returns for a change of mind, a misjudged size or an altered decorative project cannot be accepted.
This exclusion does not deprive the Client of any of the statutory guarantees set out in clause 8, nor of the right to replacement or refund where a work arrives damaged or non-conforming.
Orders placed by a business in the course of its activity carry no right of withdrawal in any event.
8. Statutory guarantees
Independently of any commercial guarantee, ORIAN remains bound by:

the statutory guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), for two years from delivery of the work;

the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), for two years from discovery of the defect.
Under the guarantee of conformity, the Client may request repair or replacement of the work and, failing that, a price reduction or termination of the contract. The Client need not prove the existence of the lack of conformity during the twenty-four months following delivery.
The pictorial variations described in clause 2 do not constitute a lack of conformity.
9. Claims on receipt
The Client must inspect the work on receipt.
Any transit damage or apparent non-conformity must be reported to contact@oriancollection.com within 48 hours of delivery, with photographs of the outer packaging, the inner packaging and the work itself.
This report is required in order to pursue a claim against the carrier and the insurer. After this period, only the statutory guarantees in clause 8 remain available.
10. Intellectual property
The sale of a work transfers ownership of the physical object only. It assigns no copyright.
The Client may photograph the work in their interior for private use or to present their own project (an interior designer's portfolio, for example), provided ORIAN Collection is credited.
Any reproduction, adaptation, commercial exploitation, derivative edition or advertising use of the work requires ORIAN's prior written consent.
11. Liability
ORIAN accepts no liability for damage resulting from unsuitable hanging, prolonged direct sunlight, excessive humidity, proximity to a heat source, inappropriate cleaning, or any handling by the Client or a third party after delivery.
ORIAN's liability is in any event limited to the price of the work concerned.
12. Personal data
Processing of Client data is described in the Privacy Policy.
13. Mediation and disputes
Under articles L612-1 et seq. of the French Consumer Code, consumer Clients may refer a dispute free of charge to the following consumer mediator for amicable resolution: CM2C.

Recourse to mediation requires that a written complaint has first been sent to ORIAN and has not received a satisfactory response.
These Terms are governed by French law. Failing amicable resolution, the French courts have jurisdiction. For professional Clients, exclusive jurisdiction is granted to the courts of Paris.
